It is true that in earlier times in the US that Native Americans did not have birthright citizenship. Native Americans didn´t have birthright citizenship as they were considered to have been born in a foreign land ie their own sovereign nation. Not because they had citizenship with another government.
Trump lawyers in the Justice Department are confusing the scenario saying that Native Americans didn´t have birthright citizenship because they had citizenship with another government, their tribe, just like their argument that children born here to immigrants don´t have birthright citizenship because they have citizenship with another government.
14th Amendment language is pretty staightforward:
All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside.
Given the right using faked photos and documents, isn't it just fair tit-for-tat to do the same to them?
